Is it true that the R4 DS card can't play some of the latest games?

I hear that due to new Nintendo DS videogames having some sort of "protection" against these kind of cards, some of the newest games can't be played with it?

I also hear that people make patches and all for these 'protected games'. But Is it really true about these 'protected' games? Kernel Updates from R4 DS website doesn't fix any of this?
