수입ㆍ판매업자에 실형 선고

R4, DSTT 등 이른바 ‘닥터 툴’로 불리는 불법 복제 소프트웨어 유통업자에 대해 법의 철퇴가 내려졌다.

서울남부지방법원에 따르면 지난 8일 R4 등의 불법 장치를 수입ㆍ판매한 업자에 대해 컴퓨터프로그램 보호법 위반으로 징역 8개월의 실형이 선고됐다. 이번 판결은 유통 업자에 대해 내려진 직접적인 처벌 명령이자 불법 소프트웨어 제작 및 유통에 대한 법원의 강력한 근절 의지를 확인할 수 있다는 점에서 기존 유통망에 적잖은 파장을 몰고 올 것으로 보인다.

‘닥터 툴’은 닌텐도 DS Lite에서 구동되는 불법 소프트웨어로 P2P 사이트에서 불법 복제된 게임을 내려받아 넣기만 하면 누구나 이용 가능하다. 용산을 비롯해 온ㆍ오프라인 장터에서 손쉽게 구매할 수 있을 정도로 닌텐도 유저 사이에 ‘머스트 해브 아이템’으로 손꼽히고 있다.

사건을 의뢰한 한국닌텐도의 고다 미네오 대표는 “저작권 침해에 대한 법적 대응은 한국시장 진출 이후 게임 인구 확대와 더불어 강력하게 추진해왔던 활동 중 하나”라면서 “앞으로도 한국 비디오 게임 산업의 발전을 저해하는 R4 등 불법 장치의 수입ㆍ판매를 비롯한 각종 위법행위에 대해 단호한 자세로 법적 조치를 강구할 방침이다”라고 입장을 표명했다.

컴퓨터프로그램 보호법 제30조 제2항에는 “누구든지 기술적 보호조치를 무력화하는 기기ㆍ장치ㆍ부품 등을 제조ㆍ수입하거나 공중에 양도ㆍ대여 또는 유통하여서는 안된다”라고 규정하고 있다.
